If you have not strolled down the 1300 block of Broadway, there is a new store next to the Diamond Center. Jay's Smoke Shop has opened the doors. Unfortunately the name is deceptive. It isn't of the same quality as the Smoke Shop on Burlingame Avenue.

You will not find newspapers from throughout the US, nor will you find a plethora of magazines. What you will find is

An adult porn shop in the back of the store with anything and everything you do not want in your neighborhood. Was this issue addressed in the permitting process, if so who voted to approve the store? And if not, what is the city going to do?

Well, I guess Abecrombie needed a place for their old posters and catalogs!

Oh jenn, come on. A visit to the new smoke shop may have you reconsider A&F. It’s not just the back room shop…the front room is loaded with suggestive stuff, drug/tobacco/sex related. Generally, Webster defines porn as “writings, photographs, movies, etc., intended to arouse sexual excitement, esp. such materials considered as having little or no artistic merit.” When asked, a person at the shop described an object I referred to as a “bong”, as a “piece of art”.

I suppose BeBe, Manji Boutique, Sephora and Victoria’s Secret (though not in Burlingame) as well as others could fall under the Webster porn definition. The Sephora salespeople will confirm the crowd of adolescent boys that hang out in front of their store awaiting the girls to emerge primped, styled. and smelling lovely, and dressed in their new skimmpy outfits from BeBe. If that’s not arousal…hmmm. Anyhow, please go visit the new smoke shop and decide on your own before comparing it to A&F.

Ah, the journey through the city’s various laws regarding an adult business was like a journey through a thick forest, during darkness, while in a very heavy fog. If you are having trouble sleeping, the following should be of help to you.

Based upon the information I have received, this business in being looked into.

    Chapter 25.76
    Section 25.76.020 Definition
“Adult-oriented business” or “adult oriented business” has the same meaning as defined in section 10.58.015 of this code and incorporating into that term the definitions contained in that section.

    Section 25.76.030 Locational requirements
    (a) No adult-oriented business shall be established or located in any some in the city other than the C-4 zone. Note: the store in a C-1 zone.

    Chapter 10.58
    Section 10.58.015 (b)Definition
‘’Adult material” means books, magazines, periodicals, or other printed matter, or photographs, films, motion pictures, video cassettes, slides, tapes, records, disks, or other forms of visual or audio representations which are distinguished or characterized by an emphasis upon the depiction or description of specified sexual activities and/or specified anatomical areas.

This may cover the p***s shaped water bottles, but may not cover the crossover utilization of smoking items…all available in the front room, at least as of today…they may have since moved backed to the “over 18” room.

See the Burlingame Daily News and The Daily Journal for more info. My hope is that the public will support the local Broadway merchants in their effort to “be a shopper’s destination.” If you do visit the new store, also please visit his neighbors.

The owners comment: “Who’s going to complain besides four or five old ladies? It’s Broadway. It’s not a big deal.”

Thanks to Rich for looking into the codes. You beat everyone to it; how dare this fellow be so flippant about it. I hope the city shuts him down.

There are alot more than four or five old ladies complaining – there have been many people asking alot of questions. He doesn’t realize how involved the residents are in this city. Also what time does this place close? I drove by the other night and it was open at 9:30p.m. All the lights were on and the door wide open!

After reading the newspaper article, it sounded as though only the merchants were involved with this issue. I would like to set the record straight, there were numerous concerned citizens, who voiced their concerns to the various city departments.

As a matter of information, according to the city code, the Chief of Police is the approving body for permits relating to “Adult Businesses. Nowhere does the city code regarding Adult Businesses address or refer to the Mayor as the authority for accepting or rejecting the permit or license for an Adult Business.

What concerns me is the FAILURE of the due-diligence on behalf of the city and AVR Reality. When the person, who applied for the business permit, informed the city representative that he was going to conduct a “retail” business; was the question ever asked, “what type of items are you going to be sold in the store?” If not, why? And there is AVR Reality. This store was being remolded, literally, right under AVR Reality’s nose. Did they ask and obtain what type of items that were going to be sold in the store?

I would like to see all applicants for a business license/permit be required to complete and submit an affidavit disclosing the type of items that are going to be sold or the type of service rendered.

Rich, are hours of operation included in the req’s? This shop seems to open late and close late.

Nothing that I have read addresses the hours of operation. As another point of contention, I have requested the code sections regarding smoking within a business establishment Seems to me that there is a health issue here and someone needs to look into it. I intend to introduce myself to the owner and let him know that I am one of his perceived 4-5 old women, who are complaining about the shop.

Obviously Mr. Jaser has underestimated the residents of Burlingame, especially those who consider Broadway their neighborhood and have children.
